By accessing this website and engaging the marketing and creative production services of Triage Marketing and Production LLC, you agree to be bound by these Terms of Service. If you do not agree, you must not use this site or engage our services.
2. Scope of Services
Triage Marketing and Production LLC provides marketing strategy, creative production, content, and related campaign services as described in proposals, statements of work, or master service agreements. Specific timelines, deliverables, and reporting schedules will be set out in your contract. While Triage Marketing and Production LLC works to meet agreed milestones, delays caused by third-party platforms, client approvals, or factors outside our reasonable control may affect schedules.
3. Financial and Billing Terms
Clients are subject to the payment terms in their agreements with Triage Marketing and Production LLC. Retainers and project fees are typically billed according to the schedule in the contract. Media and advertising spend may be billed directly to the client or as pass-through per the agreement. Failure to pay invoices when due may result in suspension of work or campaigns as permitted by contract.
4. Intellectual Property Rights
Upon full payment for agreed deliverables, clients generally receive the rights to final creative assets and materials produced specifically for them under the contract, subject to any license terms stated therein. Triage Marketing and Production LLC may retain rights to underlying methods, templates, tools, and pre-existing intellectual property used to deliver the services.
5. Limitation of Liability
To the fullest extent permitted by law, Triage Marketing and Production LLC is not liable for indirect, incidental, or consequential damages arising from the use of our services. This includes, without limitation, loss of revenue from platform algorithm changes, third-party outages, or advertising account suspensions by external networks. Marketing and advertising involve inherent marketplace risks.
6. Termination
Either party may terminate an engagement as specified in the written agreement (including any notice period). Upon termination, Triage Marketing and Production LLC will cooperate on a reasonable transition of accounts, files, and access as outlined in the contract.
